TERMS & CONDITIONS

Article 1: Definitions 

1. Business – us, Treasure Beads Amsterdam, chamber of commerce number 78265738, e-mail  address hello@treasurebeadsamsterdam.com, BTW number NL003307942B29

2. Consumer – you, any private individual who buys products or obtains services of Treasure Beads Amsterdam. 

 

Article 2: Applicability  

1. These terms and conditions are applicable for every offer and order between the business and the consumer.  

2. Situations not regulated in these terms and conditions should be assessed "in the spirit" of these terms and conditions. 

3. Uncertainties about the explanation or content of one or more provisions of our terms and conditions must be explained "in the spirit" of these terms and conditions. 

 

Article 3: The offer

1. The offer is without obligation. The business is entitled to change and adjust the offer.

2. The offer contains a complete and accurate description of the products and / or services offered. 

3. All images, specifications and data in the offer are indicative and cannot provide ground to compensation or dissolution of the agreement.

4. Pictures with products are a representation of the products offered. The business cannot guarantee that the colors shown exactly match the real colors of the products. Due to the fact that our business works with natural materials every product slightly differs in size, color and composition. 

 

Article 4: The contract

1. The contract is concluded when the consumer accepts the offer and meets the corresponding conditions.

2. The business will immediately electronically confirm receipt of the acceptance of the offer. 

 

Article 5: Right of withdrawal

1. When purchasing products, the consumer has the option to dissolve the contract without giving any reason within 14 days. This reflection period commences on the day after receipt of the product by the consumer or a representative.

2. During the reflection period, the consumer will handle the product and packaging with care. Consumer will only unpack or use the product to the extent necessary to assess whether it is necessary to keep the product. If the consumer makes use of right of withdrawal, the product shall be returned with all accessories and in the original condition and packaging to the business, in accordance with the return instructions.

3. If the consumer wishes to make use of the right of withdrawal, the consumer is obliged to make this known to the business within 14 days after receipt of the product. The consumer must make this known by contacting the business. After the consumer has expressed the wish to make use of the right of withdrawal, the customer must return the product within 14 days. The costs of returning the item must be paid by the consumers. The consumer must be able to prove that the delivered goods have been returned on time, for example by means of a proof of shipment.

4. If, after 14 days after receiving the product, the customer has not made known of the wishes to make use of the right of withdrawal, respectively the product has not been returned to Treasure Beads Amsterdam, the purchase is a fact.

 

Article 6: Costs in case of withdrawal

1. If the consumer makes use of the right of withdrawal, the costs of return will be for consumer's own account.

2. The business will repay an amount paid for the product and/or service as soon as possible, but no later than 14 days after cancellation and the returned product being received by the business. Refund will be made via the same payment method used by the consumer unless the consumer explicitly gives permission for another payment method.

3. If the product is damaged due to careless handling by the consumer, the consumer is liable for any diminished value of the product.

 

Article 7: the Price 

1. Unless explicitly mentioned otherwise all prices are in EUR and are inclusive of 21% VAT. 

2. The business reserves the right to offer special offers and discounts on need-to-be basis. 

3. No right scan be derived by the consumers from any previous deals and discounts. 

4. Local charges, such as but not limited to sales tax, customs duty, may occur depending on your region and local customs duties. These charges are at the customers own expense.

 

Article 8: Delivery 

1. All delivery times are indicative. The consumer cannot derive any rights from any stated periods. Exceeding a term does not entitle the consumer to compensation.

2. If delivery of an ordered product proves to be impossible, the business will make everything it its power to make a replacement article available. 

3. The risk of damage and / or loss of products rests with the business until the moment of delivery to the consumer

 

Article 9: Payment 

1. The payments are accepted strictly through the electronic bank transfer. 

2. In case of consumers failing to perform the payment the order is automatically cancelled. 

 

Article 10: Dispute 

1. All rights, obligations, offers, orders and agreements to which these terms and conditions apply including the terms and conditions themselves are governed by the law of the Netherlands. All disputes will be handled exclusively by the Dutch court and its judiciary. This applies also to consumers who are residing outside of the Netherlands. 

2. CISG is not applicable. 

 

Article 11: Miscellaneous 

1. The business provides services to the customers who are 18 years of age or older. 

2. The products offered by Treasure Beads Amsterdam contain small parts and therefore should be kept safely away from children. 

3. It is the responsibility of the consumer to ensure that no damage is caused by the use of the products. The business will not be held accountable for any type of damage, injury or disability caused by Treasure Beads Amsterdam products. 

 

Article 12: Intellectual property 

1. All content of www.treasurebeadsamsterdam.com is the property of Treasure Beads Amstedam. Using any images, videos, text, code or other elements of the site fully or in part is strictly prohibited.
